LEGAL NOTICE OF SIROKO TV

1. Object of the Legal Notice

This Legal Notice contains the information that, in compliance with Article 10 of Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce (hereinafter, the “LSSI-CE”), the information society service provider makes available to service users and the competent authorities.

This Legal Notice applies to the audiovisual content platform called Siroko TV (hereinafter, the “Platform”), accessible through the website https://www.siroko.com/tv and mobile applications for iOS and Android operating systems.

Access to and use of the Platform are governed, in addition to this Legal Notice, by the Terms and Conditions of Use and the Privacy Policy published on the Platform, documents that the user acknowledges having read and accepted.

In accordance with Article 37 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (hereinafter “GDPR”), Siroko Solutions, S.L. has appointed a Data Protection Officer, whose contact details are:

Users may contact the Data Protection Officer to exercise the rights recognized in articles 15 to 22 of the RGPD and for any questions regarding the processing of their personal data, under the terms and through the channels established in the Privacy Policy.

4. Single point of contact for the purposes of the Digital Services Act

In accordance with Articles 11 and 12 of Regulation (EU) 2022/2065 of the European Parliament and of the Council of 19 October 2022 on a single market for digital services (hereinafter “DSA Regulation”), Siroko Solutions, S.L., in its capacity as a data hosting service provider, designates the following single points of contact:

  • Contact point for authorities (European Commission, Digital Services Coordinator of the Member State of establishment -Spain- and other competent authorities), in accordance with Article 11 of the DSA Regulation: dsa@siroko.com.

Communications addressed to the contact points may be sent in Spanish or English. The notice-and-action procedures, as well as the available complaint mechanisms, are regulated in detail in the Platform’s Terms and Conditions of Use.

5. Ethics and whistleblowing channel

In compliance with Article 6 of Law 2/2023, of February 20, regulating the protection of persons who report regulatory violations and anti-corruption, Siroko Solutions, S.L. has enabled an Internal Reporting Channel, accessible through the following link:

The Internal Reporting Channel has been established in accordance with the principles of confidentiality, integrity, independence and whistleblower protection set out in the aforementioned Law 2/2023.

6. Intellectual and industrial property

The contents of the Platform, including but not limited to software, graphic design, text, trademarks, logos, trade names, databases and any other elements subject to protection, are owned by Siroko Solutions, S.L. or third parties who have authorized their inclusion, and are protected by Royal Legislative Decree 1/1996, of April 12, which approves the Revised Text of the Intellectual Property Law, by Law 17/2001, of December 7, Trademarks, and other applicable Spanish, European and international regulations.

The specific provisions governing the use, licensing, prohibitions and liability relating to the content of the Platform are detailed in the corresponding section of the Terms and Conditions of Use, to which this Legal Notice expressly refers.

7. Personal data protection

The processing of users’ personal data is governed by the Platform’s Privacy Policy, which is accessible on the Platform and which the user acknowledges having read and accepted prior to using the service.

The Privacy Policy informs the user, under the terms of articles 13 and 14 of the RGPD, about the identity of the data controller, the purposes and legal bases, the recipients, the storage periods, international transfers, the rights of the data subject and the ways to exercise them.

8. Links to third party sites and services

The Platform may contain links to websites or services operated by third parties. Siroko Solutions, S.L. does not control such sites or services and is not responsible for their content, operation, availability, privacy practices or any other matter relating to them.

The presence of a link does not imply any recommendation, association, sponsorship or relationship between Siroko Solutions, S.L. and the third party operating the linked website or service. Access to such sites or services is at the user’s sole risk.

9. Out-of-court online dispute resolution

In accordance with Article 14 of Regulation (EU) No 524/2013 of the European Parliament and of the Council of 21 May 2013 on Online Dispute Resolution in Consumer Matters, consumers residing in the European Union are informed of the existence of the European Commission’s Online Dispute Resolution Platform, accessible through the following address:

Through this platform, consumers can file claims arising from contracts concluded online, without prejudice to their right to go to the competent judicial bodies.

10. Governing law and jurisdiction

This Legal Notice is governed by Spanish law. The applicable law and jurisdiction for disputes arising from the use of the Platform is regulated in the corresponding clause of the Terms and Conditions of Use, which expressly refers to this Legal Notice, preserving in any case the mandatory laws that apply to users as consumers.

11. Modification of the Legal Notice

Siroko Solutions, S.L. reserves the right to modify this Legal Notice at any time, either for technical, operational or legal reasons. The modifications will become effective as soon as they are published on the Platform. Users are advised to review this document periodically.

12. Language

The Spanish-language version of this Legal Notice shall be the original and legally binding version. Translations into other languages are provided for information purposes only and, in case of discrepancies, the Spanish version shall prevail.
