RIGHT OF WITHDRAWAL

INFORMATION

1. What is the Right of Withdrawal?

The right of withdrawal is your right, as a consumer, to withdraw from the distance sales contract concluded through www.siroko.com (hereinafter, the “Seller”), without giving any reason and without incurring any additional cost, within the statutory period.

This right is recognised and governed by Articles 102 to 108 of Royal Legislative Decree 1/2007 of 16 November approving the consolidated text of the General Law for the Protection of Consumers and Users and other supplementary laws, as well as by Directive 2011/83/EU of the European Parliament and of the Council of 25 October 2011 on consumer rights.

The right of withdrawal constitutes a statutory minimum protection. Any terms voluntarily offered by www.siroko.com that are more favourable to the consumer will prevail over the statutory minimum. Siroko grants consumers a period of 30 calendar days in which to exercise their right of withdrawal.

2. How long do I have to exercise my right of withdrawal?

The consumer has 30 CALENDAR DAYS in which to exercise the right of withdrawal, calculated from:

— For contracts for the sale of goods: the day on which the consumer, or a third party indicated by the consumer other than the carrier, acquires physical possession of the goods.

— For contracts involving multiple deliveries or separate parts: the day on which the consumer or a third party acquires physical possession of the last item or part.

If the final day of the period falls on a public holiday or non-working day, the period will be extended until the next working day.

3. How can I exercise my right of withdrawal on www.siroko.com? — Information on the Integrated Online Withdrawal Function

To exercise the right of withdrawal, the consumer may use any of the following methods:

a) Integrated Online Withdrawal Function, by clicking the button:

Using the withdrawal form available at https://www.siroko.com/withdrawal, which is directly accessible from this page and from the “Right of Withdrawal” link in the website footer. Registration is not required. The consumer will immediately receive confirmation by email stating the exact date and time at which the request was submitted. This function complies with the requirements of Article 11a of Directive 2011/83/EU, as amended by Directive (EU) 2023/2673.

b) Form (included in Annex 1 to this document):

Using the withdrawal form included in ANNEX 1 to this document (which is set out in Annex I, Part B, to Royal Legislative Decree 1/2007 of 16 November). It must be sent to our company by email or post, using a method that provides reliable evidence of dispatch.

The consumer will have exercised the right of withdrawal within the applicable period where the communication is sent before that period expires, regardless of when it is received by us. For the purposes of proving that the right was exercised within the applicable period, the relevant date will be the date on which the declaration was sent or the request was registered on the online platform, rather than the date on which it was received by the trader.

4. What are the effects of exercising the right of withdrawal?

www.siroko.com will reimburse the consumer for all payments received, including, where applicable, delivery costs (with the exception of any additional costs resulting from the consumer’s choice of a type of delivery other than the least expensive type of standard delivery offered by www.siroko.com), without undue delay and, in any event, no later than fourteen (14) calendar days from the date on which it is informed of the decision to withdraw.

The reimbursement will be made using the same means of payment as the consumer used for the initial transaction, unless the consumer has expressly agreed otherwise, and provided that the consumer does not incur any fees as a result of the reimbursement.

www.siroko.com may withhold reimbursement until it has received the goods or until the consumer has supplied evidence of having returned the goods, whichever occurs first, except where www.siroko.com has offered to collect the goods.

5. What obligations does the consumer have after exercising the right of withdrawal?

The consumer must return or hand over the goods directly to www.siroko.com or to a person authorised by the Seller to receive them, without undue delay and, in any event, no later than fourteen (14) calendar days from the date on which the consumer communicates the decision to withdraw.

The deadline will be deemed to have been met if the consumer returns the goods before the relevant period has expired."

 

6. What exceptions to the right of withdrawal are provided for by law?

Please note that the right of withdrawal is subject to a number of exceptions. These are set out in Article 103 of Royal Legislative Decree 1/2007. The right of withdrawal will not apply to contracts concerning:

a) The supply of goods made to the consumer’s or user’s specifications or clearly personalised.

b) The supply of sealed goods which are not suitable for return due to health protection or hygiene reasons and which have been unsealed after delivery."

 

7. Is this right different from returning a product, for example to exchange it for a different size?

The right of withdrawal is entirely separate from the product return process available on www.siroko.com. Accordingly, if you wish to RETURN A PRODUCT for other reasons (for example, to exchange it for a different size), you must follow the instructions set out in the PRODUCT RETURNS section."
